A clear license for Petrisys applications.

1. Agreement and applicability

This End User License Agreement ("EULA") applies to Petrisys proprietary software applications (the "Software") unless the Software is supplied under a different license. By installing, copying or using the Software, you accept this EULA to the extent an enforceable agreement is formed under applicable law.

The Terms of Use and Privacy Policy also apply where relevant.

2. Limited license grant

Subject to this EULA, Petrisys grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for its intended lawful purpose on devices or systems you own or control, or are otherwise authorized to use.

Any purchase, subscription, seat, device, organization, evaluation or other scope shown in an order, app-store listing, product page or written agreement forms part of the permitted license scope.

3. Ownership and reserved rights

Petrisys and its licensors retain all ownership and intellectual-property rights in and to the Software and documentation. You receive only the rights expressly granted in this EULA. All other rights are reserved.

4. License restrictions

Except where Petrisys expressly permits it in writing or applicable law prohibits the restriction, you may not:

• copy, distribute, rent, lease, sell, sublicense or commercially host the Software beyond the licensed scope;
• reverse engineer, decompile, disassemble or attempt to derive source code;
• circumvent licensing, security or technical controls;
• remove proprietary notices or represent Petrisys software as your own;
• use the Software in an unlawful manner or to violate third-party rights.

5. Application data and privacy

Petrisys applications are designed not to collect user data for Petrisys. Data that remains on your device or within systems you control is your responsibility, including backup, retention, access control and recovery.

If you intentionally connect a third-party service, API, cloud provider or AI model, information sent to that third party at your direction is subject to the third party's terms and privacy practices. See the Data & Confidentiality Statement.

6. Third-party and open-source components

The Software may include or interact with third-party or open-source components. Those components may be governed by separate notices and licenses. Where an applicable third-party or open-source license grants rights that conflict with this EULA, that license controls only for the relevant component.

7. Updates, changes and discontinuation

Petrisys may provide updates, fixes or new versions, but is not obligated to do so unless required by a separate written agreement or applicable law. Updates may add, modify or remove features. Petrisys may discontinue a free Software product or version, subject to any non-waivable rights.

8. No automatic support obligation

Unless Petrisys agrees otherwise in writing, the license does not include guaranteed maintenance, custom development, uptime, response times, data recovery, compatibility work, training or technical support.

9. Termination

This EULA remains effective until terminated. Your rights under it end automatically if you materially breach the EULA and fail to cure the breach where a cure is legally required. On termination, you must stop using and, where reasonably possible, delete unlicensed copies of the Software. Provisions concerning ownership, disclaimers, liability and governing law survive.

10. “AS IS” software

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS, AND PETRISYS DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY AND ERROR-FREE OPERATION.

Any mandatory warranty or consumer right that cannot lawfully be excluded remains unaffected.

11. Limitation of liability

The limitation-of-liability provisions in the Terms of Use apply to the Software. To the maximum extent permitted by law, Petrisys is not responsible for indirect or consequential loss, loss of data, loss of business or reliance on unverified automated output, and aggregate liability is subject to the cap stated in those Terms.

12. App-store and platform terms

If the Software is obtained through an app store, marketplace or platform, the provider's mandatory distribution terms may also apply. Where those mandatory terms conflict with this EULA, they control only to the extent required for distribution through that provider.

13. Governing law

Except where mandatory law requires otherwise, this EULA is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Subject to non-waivable rights, Ontario courts have jurisdiction.
